Acceptance of Terms & Conditions

Please read the Terms & Conditions carefully before accessing and using the services on HR1TECH.com Career Website (hereinafter called the "HR1TECH Website") of HR1TECH Technology Joint Stock Company (hereinafter called the "Company"). When you access to and use HR1TECH.com Website, it is considered that you accepted the Terms of Use.

HR1TECH Services

The HR1TECH Website is a Web site on the Internet that is designed to be a bridge between the employers and the candidates. The employers can post recruitment information, find candidate resumes or other services on the website. The candidates can download personal information and work experience profiles, view recruitment information from employers and apply for suitable jobs.

In order to use the full range of services on the HR1TECH Website, you need to register to create an account and provide certain personal information but not limited to an email address for communication between you and the HR1TECH as well as other users later.

By signing up, you agree to receive our newsletters, emails and other communications about the products or services of the HR1TECH Website. Whenever you wish not to receive them anymore, you should notify the HR1TECH Website by checking the unsubscribing function available on HR1TECH Website or at the bottom of the HR1TECH Website emails. All your personal information will be preserved and handled securely in accordance with the Privacy Policy of the HR1TECH Website.

You can order the services or products at the price list available on the HR1TECH Website and become binding only when you have paid or your payment information has been confirmed.

The Company shall reserve the right to make changes to its services, products, pricing models and prices from time to time without prior notice to the user if it is considered appropriate.

HR1TECH reserves the right to refuse to provide services to individuals and organizations which in accordance with the laws or at the Company’s sole discretion:

In case HR1TECH has provided services to you and/or your company, however, later finds out that you and/or your company are one of the subjects that HR1TECH refuses to provide the above service to, the Company shall, at its own discretion:

Ordering Services and Payment

You may order one or more of the services available in the List of HR1TECH Services by Purchase Order and/or Service Agreement.

If the service Customer buys is a Job Posting Service:

If the service customers purchased is a CV Search:

HR1TECH' service is a pre-paid service by cash, wire transfer or credit card. The list of accepted credit cards will be publicized on the HR1TECH Website. The Service Fee must be paid on the date of customer's order confirmed.

If after the Payment Date, the customer still has not completed, then HR1TECH has the right to suspend the provision of the service until the payment is completed full.

HR1TECH will issue a VAT Invoice in accordance with current Vietnamese laws upon customers' request. Customers are responsible for the accuracy of the information used for the VAT Invoice.

Provision for Use of Services

After you have paid the Service Fee and/or activate the Purchased Services, we will not accept any requests to terminate or cancel the Purchased Services, refund the Service Fee or change any service.

You will manually create an account with a password to use the service on the HR1TECH Website. Employers are responsible for securing password and only using their account (username & password) for their own recruitment purposes. In case the Employers lose or forget the password, immediately notify HR1TECH for timely support.

You are entitled to post your recruitment advertisement and/or a link on the HR1TECH Website to the recruitment information on your website, and you are solely responsible for the accuracy and legality of the content. However, you are not allowed to add all formats of email address and/or phone number and/or fax number or any other form of contact information.

You must activate the Purchased Services within the use duration. When the use duration is invalid, any purchased but not activated services will no longer be valid for use.

In the event that due to our intentional fault, after 7 (seven) working days from the date you have a written warning notice of the violation but we have not yet taken action to remedy this violation, we will refund the amount of Service Fee related to the unused services in the Purchase Order/Service Contract that we failed to provide in accordance with the agreement between the two parties.

User Rights and Responsibilities

Access to the HR1TECH Website. You are responsible for providing all hardware, software, telephone number or other communication devices and/or service to connect to the Internet and access the HR1TECH Website, at the same time be responsible for all Internet access charges, telephone charges or other fees or charges incurred in connecting to the Internet and accessing the HR1TECH Website.

User ethics. When using the HR1TECH Services and accessing the HR1TECH Website, you are fully aware of the following prohibitions:

Mass registration and automation. Accounts that are registered automatically and/or systematically registered in mass, at the Company’s sole discretion, will be considered as breach and will be handled with as regulated in this Terms and Conditions.

Improper purposes. Any act of abusing and/or using HR1TECH Website that is deviated from the purpose of recruitment and employment opportunity seeking, at the Company’s sole discretion, may be considered as breach and will be dealt with as regulated in this Terms and Conditions.

Disturbing other Users. HR1TECH wishes to create a free and healthy environment for recruitment and job search of all Users. When you use the HR1TECH Website, please carefully consider the content you post on the Interactive Areas and the responses to other users. If HR1TECH is notified of any disturbing behavior (including but not limited to any threats, blank text or random strings of characters/words that have no meaning and/or irrelevant content to any reasonable interactive content, spamming, using any deception to attract attention or for commercial marketing purposes) that affects the use of services, restrains the ability of others to access information, causing discomfort to other Users, the Company reserves the right to immediately suspend service without notification and/or refund to any flagged User to investigate and deal with the breach as regulated in this Terms and Conditions.

Request the candidate to pay. HR1TECH does not collect money from users who apply for jobs. Collecting money from the candidate by the recruiter is completely prohibited in accordance with the current Vietnamese laws. You will strictly adhere to these regulations. In some particular cases where the candidate is required to pay any cost of goods /services to you or HR1TECH or any other third party in accordance with the laws (such as the cost of immigration procedures to come and work in another country, the cost of a work permit, the cost of vocational training ...) to be able to be recruited and work for you and /or HR1TECH, the information about these costs must be public in the Job Posting Content.

If HR1TECH detects or receives feedback from other users about any payment request related to you and /or HR1TECH that does not comply with the above provisions, the Company, immediately, has the right to suspend the provision of related services without notice and /or refund to you for investigation and handling of violations in accordance with these Terms and Conditions.

In the event that you are required by any user to pay any amount in connection with your application form or work for them, you should use your best judgment in your researching and evaluating all information, as well as consider carefully before making a payment decision. The Company will not be liable for damages or risks or losses of any kind which the user may incur when making decisions regarding interaction with other users, regardless of via HR1TECH Website or not.

Report violations. In the event that you believe that the behavior of any other user does not comply with the provisions of these Terms and Conditions, you can always notify us for reviewing.

Intellectual Property Rights

Content Career Website HR1TECH.com. You acknowledge that HR1TECH Website grants access to the Content that is protected by copyright, trademark and other proprietary rights (including intellectual property rights) (“Intellectual Property Rights”), and acknowledges such intellectual property rights are valid and protected in all existing and future media, except these expressly stated below, your use of the content will be governed by copyright laws and other applicable intellectual property laws.

You agree and acknowledge that all content on the HR1TECH Website including but not limited to resumes shall be the sole intellectual property of the HR1TECH Website and you are not allowed to alter, copy, reproduce, transmit, distribute, publish, create derivative products, display or transmit or commercially exploit any part of the content, in whole or in part. However, you may (i) make a copy in digital or in other form so that your computer hardware and software can access and view the content, (ii) print a copy of each content paragraph, (iii) create and distribute a reasonable number of copies of the content, in whole or in part, in print or digital form for internal use.

Any permitted copies of the Content must be reproduced in a form that the notices contained in the content cannot be altered, such as all Intellectual Property Right notices, and original sources attribution to "HR1TECH Website" and its URL address. You do not acquire any Intellectual Property Rights by downloading or printing Content. Any unauthorized copies or uses of the Content for commercial purposes shall be deemed as a breach and shall be treated in accordance with the relevant provisions of the law and the terms set forth in this agreement.

Content Provided by the user. You may only upload to any Interactive Area or transmit, post, publish, reproduce or distribute on or through the content of HR1TECH Website that is not subject to any Intellectual Property Rights, or Content in which any holder of Intellectual Property Rights has given express authorization for distribution over the Internet and on HR1TECH Website, without restriction whatsoever. Any Content submitted with the consent of a copyright owner other than you should contain a phrase such as "Copyright owned by [name of owner]; used by authorization." By submitting Content to any Interactive Area, you automatically accept and/or warrant that the owner of such Content, whether it be you or a third party, has expressly granted to HR1TECH Website the royalty-free, perpetual, non-exclusive, unrestricted rights and licenses to use, reproduce, modify, revise, publish, translate, create derivative works, sublicense, distribute, perform, and display such Content, in whole or in part, worldwide and/or to incorporate it in other works in any form through media or technologies now known or later developed under the full term of any Intellectual Property Rights that may exist in such Content. You also permit HR1TECH Website to sublicense to third parties the unrestricted right to exercise any of the foregoing rights granted with respect to such Content. You also permit HR1TECH Website to use your company name and corporate logo for marketing purposes.

Links; Disclaimers of Warranties; Limitations of Liability

Links. You understand that except for Content, products or services expressly available at HR1TECH Website, HR1TECH.com, its parent companies, or affiliates as well as their respective directors, officers, employees and agent controls, provides, or are not responsible for any Content, goods or services available through sites on the Internet linked to or from HR1TECH Website. All such Content, goods and services are made accessible on the Internet by independent third parties and are not part of the HR1TECH Website or controlled by the HR1TECH Website. The HR1TECH Website neither endorses nor is responsible for the accuracy, completeness, usefulness, quality or availability of any Content, goods or services available on any site linked to or from the HR1TECH Website, which are the sole responsibility of such independent third parties; therefore, your use is at your own risk. HR1TECH Website, its subsidiary and parent companies, or affiliates, or their respective directors, officers, employees, and agents shall be held responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused by your use of or reliance on any Content, goods or services available on any site linked to or from the HR1TECH Website or your inability to access the Internet or any site linked to or from the HR1TECH Website.

Compliance and Violations Handling

You must strictly comply with the provisions of the Purchase Order, the Service Contract, and the Terms & Conditions as a prerequisite for the use of the Service. In case you violate any of the provisions of your Purchase Order, Service Contract and these Terms & Conditions, we reserve the right to remove any of your recruitment, content or links, or to remove, disable the account using the HR1TECH website if deemed necessary and suspend and/or terminate the service provision without having to return the Service Fee or the service amount that you have paid but have not used up. At the same time, we reserve the right to enforce you to recoup for damages or losses arising from your breach.

Security

You agree with the information security commitment regarding the Service, the transaction execution, and/or any other information obtained from the execution of a transaction. You will cooperate in preventing and be against the acts of any third party illegally copying and using your recruitment content or your other information on the Internet.

You are not allowed to disclose, share or sell candidates’ information that you collect from using the service to any other third party in any form without prior written consent of HR1TECH.

Other problems

This Agreement contains the entire agreement between the HR1TECH Website and you, and supersedes all prior agreements on this subject. The HR1TECH Website may modify this Agreement or any other policy at any time and from time to time, and such modification shall be valid immediately upon notice of it being published in a conspicuous place on the HR1TECH Website.

You agree to review this Agreement periodically to become aware of any amendments. If you do not accept these modifications, you must stop accessing the HR1TECH Website. Your continued accession and use of the HR1TECH Website after the following notice of such modifications shall be considered as an acceptance of all such modifications.

If any provision of this Agreement or of any other policy is invalid or unenforceable, such content shall be explained in accordance with the most recent applicable law to reflect the original intent of the parties and the remainder shall continue in full force and effect. The failure of HR1TECH Website to require or enforce strict performance of any provision of this Agreement shall not be considered as a denial of any term or right. This Agreement will be governed by the laws of the state or province of the HR1TECH Website, unless there is a conflict of rules of law, you and the HR1TECH Website are subject to the sole and exclusive right of enforcement of the court of that province or state.

This Agreement is exclusively for you and you cannot transfer your rights or obligations to anyone. All logos, affiliate names, products, trade names or service marks appeared herein may be are the trade names or service marks of their respective owners. References to any trade names, service marks and links to or from the HR1TECH Website are done strictly for clarity and identification and not organized an endorsement by the HR1TECH Website of products, services or information provided by the owner of a trade name, service mark or link, recommendation or endorsement of the HR1TECH Website by the owner of such product, service or link.
